The basic copyright rules apply to my art: Do not redistribute, repost, alter, copy, sell, edit, redraw, trace and/or claim as your own.
"Sharing" is only allowed when given permission from myself or when proper accreditation is given. Proper credit is considered: citing my name and link to my site attached to the unaltered image.
Referencing is allowed when credit is given. This does not include tracing, cropping or manipulating.
Selling or reselling of my art is only allowed when you own the original artwork, rights or print from a legitimate source. Any prints not made by myself, or by approved source (such as through Deviant), is not permitted to be sold or resold.
Personal use exception: Art maybe used as a personal desktop wallpaper or basic print for you to enjoy as long as they remain unaltered (do not removed watermark) and in your possession.
Watermark Disclosure All images will be watermarked with the artist information and signature when the artist retains rights. When full rights are purchased to an image, or when the artist does not retain the rights, only a small signature maybe used. In the later case, watermarks for the owner can be placed on the image per request. (Note to potential commissioners: This will increase the price of the commissions as I will no longer have rights and loose possible income that could be made through prints.) Exceptions will be traditional works or "poses". The original traditional work will only have the artist signature, whether rights are retained by the artist or not. "Poses" will have neither a watermark nor signature, due to how they are used. However, digital copies will be watermarked accordingly.
Sharing and Using A person that has commissioned or is receiving a commission piece (as a gift) has the right to repost or "share" the commissioned piece to a personal website, social media, forum, etc, so long as the image remains unaltered and proper credit is given (citing my name and website). In cases where this is not possible, like in poses and icons, people just provide the information upon request. This does not include other online galleries that may confuse a viewer to who the creating artist is and who has permission to use it (ie: public folder on Photobucket, or uploading it to your Deviantart). If you own the original piece or approved print, you can resell it if you wish. However, additional prints cannot be made from high resolution files or the original artwork to resell, unless you have retain the rights through the commission process.
"Unclaimed" refers to if an art work, commission, auction, purchase that has not be claimed, paid for in full, or the purchaser has not communicated with the seller in an extended period of time. Basically the sale or commission has fallen through.
"Purchaser" refers to the person(s) commissioning, buying, purchasing, and placing a bid on the item(s).
"Seller" refers to me, the one selling the art work, auction, or item of desire.
After a purchase has been made through an auction, e-mail, or by any means available of purchase, contact must be made about payment to myself through e-mail, letter, phone, or other means of communication. Please do not wait for the seller to contact the purchaser first. Although attempts will be made to contact the purchaser.
After one week, it is expected some form of contact be made from (or to) the purchaser about means of payment, or situation why they unable to place a payment on the purchase. If you are unable to make a full payment of the purchase, an agreement maybe made between the seller and purchaser. However, if no contact or discussion takes place after a maximum of three weeks, then the item is subject to be deemed unclaimed. This means the item can be put back up for auction or immediate purchase by another.
If contact is made but no payment is ever received two weeks after the agreed time(s), the art with then be forfeited. Meaning that the art becomes unclaimed and can be resold. The Seller holds the right weather to refund all or any of the money received, as money received can be considered compensation for time spent working on the item or losses that could be incurred due to the purchaser's negligence.
I, the seller, am not responsible to make sure the commissioner or purchaser of the item makes contact with myself. Although attempts will be made on my part to contact the purchaser. If no contact is made, I can only assume that if the purchaser does not make contact, respond, makes payment(s), or any agreement on the purchase, that they are no longer interested in the item and have voided the transaction.
Payment Payment(s) should be made to me shortly after the auction or “purchase,” when all costs have been figured. Although if other terms are agreed upon a head of time on how payment(s) will be made, please follow that agreement. It is expected to hear from the purchaser and know the situation within a reasonable amount of time.
Personal checks are no longer accepted. The acceptable payment type is through Paypal. Please make sure that all your information is up to date on your account and any information that is needed be included when sending your payment. Payments should be made under the purchase tab, using goods or services option. I hold the right to decline or refund payment(s) that do not include the correct amount or information.
Refunds In some situations, refunds maybe acceptable for full or partial payments where little or no work has been done on a commission. The amount of the refund, when acceptable, will be determined in a case-by case scenario. The artist holds the right to retain funds to cover any materials used, as well as time. Refunds are generally not given for artwork that has been completed or is sold as is in Originals, Resell, or print section of this site. There are no refunds on shipping charges.
Requests and Commissions
Requests for commissions that are received are not guaranteed acceptance by myself (the artist). They can be rejected or declined for any reasons. Any commission (an accepted request) that does not have any special terms specified and agreed upon will be subject to the default terms described on this page. This includes a deadline or timeline. If one is not set, the artist will work on her time. You can check the update and progress of your commission on this page. If you have lost contact with the artist or wish for an update, please e-mail me.
Quotes As part of the business, quotes are often given as a rough estimate of the actual cost maybe. When getting and receiving an estimate, please be aware that "quote" will only be valid for a short time after it is made. For most personal, non-commercial pieces, this may be only for a month or two. For commercial, or more professional pieces, the estimate may last longer. As prices vary depending on demand and skill level and quality being produced at the time. If you are commissioning right after receiving a quote, you will not have to worry about the price changing (exceptions: excessive editing needs, changes, additions, etc). However, if you are just getting a ball park quote, and don't initiate a commission until months later, that price is likely to have changed. It is advised to receive an estimate or quote within a short time of planned commissioned work.
Conclusion and Contact
I hold to right to change, edit, or modify the terms of the TOS, TOU, Copyright, unclaimed art, and other terms on this site at any time without notice. Any existing agreement made specifically with another (the commissioner, purchaser, buyer) cannot be modified without notice.
The name "Chenneoue" is original to myself, as I created the name, and am unaware of any origins that have a similar or same name(s). I do use it as an alternative name, alias, pen name, and on-line “handle.” I have been using "Chenneoue" as a name since 2000. Before that, I used "Mimay" or a similar name. You may also see me use the alias "Fuzzee" on some sites.
